These Terms of Use (“Terms”) govern your access to and use of med·toolkit (the “Service”), operated by Sparklet, Inc., doing business as Med Toolkit (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Research tool, not medical advice. med·toolkit helps with medical research writing, literature work, and methods prototyping. It does not provide medical, clinical, or diagnostic advice, and its output must never be used to make decisions about the care of an individual patient. Any datasets generated by the Service are synthetic and marginal-only — they describe aggregate distributions for methods prototyping and do not represent real patients.
1. Eligibility & accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide and for all activity under your account.
- Keep your password confidential and do not share your account.
- Notify us promptly at hello@med-toolkit.com if you suspect unauthorized use of your account.
- We verify sign-ups by emailing a one-time code; you are responsible for maintaining access to the email address on file.
2. Acceptable use
You agree not to:
- Use the Service to make clinical, diagnostic, or treatment decisions for real patients, or to represent its output as validated medical guidance.
- Upload protected health information (PHI), personal data of identifiable patients, or any data you are not authorized to process.
- Reverse engineer, scrape, overload, or attempt to gain unauthorized access to the Service or its underlying models and infrastructure.
- Use the Service to generate content that is unlawful, infringing, fraudulent, or that fabricates research results for publication or grant purposes.
- Resell or redistribute access to the Service without our written permission.
You are responsible for reviewing, verifying, and taking full responsibility for any output before relying on or publishing it.
3. AI-generated content
The Service uses large language models and statistical methods to generate text, citations, and datasets. AI output can be inaccurate, incomplete, or fabricated, including plausible-looking but non-existent citations. You must independently verify all facts, references, and figures. We make no warranty that output is accurate, original, or suitable for any particular purpose.
As between you and us, you own the output you generate, subject to your compliance with these Terms. You are responsible for ensuring your use of output complies with the publication, authorship, and research-integrity policies that apply to you.
4. Payments, credits & unlocks
The Service is offered on a freemium basis: you can preview results for free and pay to unlock full results. Prices are shown before purchase and may be displayed in your chosen currency.
- Credit. You may add credit to your account. Credit is a prepaid balance used to unlock results and features; it has no cash value and is non-transferable.
- Unlocks. Unlocking a result grants you continued access to that specific result. Payments for unlocks and credit are generally non-refundable except where required by law or at our discretion.
- Processing. Card payments are processed by our payment provider (Stripe). We do not store full card numbers.
We may change prices prospectively. Changes do not affect credit you have already purchased.
5. Intellectual property
The Service, including its software, design, and content we provide, is owned by Sparklet, Inc. and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. All rights not expressly granted are reserved.
6. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, secure, or error-free. Nothing in the Service constitutes medical advice.
7. Limitation of liability
To the maximum extent permitted by law, Sparklet, Inc. and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or research outcomes, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100.
8. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to others or to the Service. Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.
9. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance.
10. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.
